With the Odds Against Him, Former Leader of Tucson Drug Ring Found Not Guilty

TUCSON, Ariz., Oct. 3 /PRNewswire/ — Facing more than 30 years in jail, Mark Simmons, the alleged former leader of a drug distribution ring was found not guilty yesterday at the Tucson Federal Court House. With the odds stacked against him and his defense team, Simmons will now have a future as a free man.

Mark Simmons allegedly used his trucking company, G & S Trucking to ship over 5,000 pounds of marijuana and multiple kilograms of cocaine from Tucson to areas of Ohio and Pennsylvania from 2000 to 2004.

Drug arrests of Simmons’ supposed clientele across the United States ultimately led to alleged distribution leader’s arrest in 2004. Simmons has since spent 2 years in jail.

“My client was never a guilty man,” said Simmons’ attorney, Jim Parkman of The Cochran Law Firm, founded by the late, famed attorney Johnnie Cochran, Jr.

Simmons’ legal team consisted of some of the most prestigious criminal defense attorneys in the nation: Jim Parkman, Martin Adams, and William White, whom defended former HealthSouth CEO Richard Scrushy in 2005; where their client was acquitted of over three-dozen fraud and money laundering charges in a massive $2.7 billion earnings overstatement.

“The prosecutors had substantial evidence mounting against Simmons — it just did not point towards guilt on the crimes charged,” Jim Parkman continues, his southern drawl booming.

During Simmons’ three week trial, numerous co-conspirators testified against him, where prosecutors also presented various undercover taped conversations to the jury. These conversations between Simmons and the co-conspirators were intended to surely convict him.

Prosecuted under what is often referred to as the “drug kingpin law,” Simmons was found not guilty on continuing criminal enterprise, and two counts of possession with intent to distribute over 1,000 kilograms of marijuana.

His legal team’s first case tried outside the state of Alabama since the Scrushy trial, Simmons wept with joy when the verdicts were read.
